TERMS AND CONDITIONS

This agreement (the “Agreement”) is entered into between Future Home Restoration (“We”, “The Company” or “Contractor”) and the Client (“You”), as of the date of signature.

  • Scope of Services

Future Home Restoration (“The Company”) will perform only the work described in this Work Order. Any additional service not included in the original description will require a Change Order signed by both parties.

  • Change Orders: may generate additional costs and modifications to the work schedule.
  • If during the execution of the project hidden conditions, structural damage, moisture, mold, termites, electrical, plumbing or other pre-existing conditions not detectable during the initial inspection are discovered, corrective work will be considered additional and will require Client approval.
  • Permits, Inspections and HOA

When the nature of the project requires it, the Company will manage or coordinate the obtaining of permits. Execution timelines may be affected by municipal approvals, inspections, homeowner association (HOA) requirements, material availability or weather conditions. Such factors are considered outside the Company’s control and will not constitute a breach of contract. Any modification required by an HOA or competent authority may generate additional costs for the Client.

  • Materials and Variations

Selected materials may present reasonable variations in color, texture, or finish compared to samples, due to natural characteristics or manufacturing variations. The Company may substitute materials with others of equivalent or superior quality when availability, discontinuation, or manufacturing delays exist, notifying the Client in advance.

  • Payments and Financing

The Client agrees to make payments as established in the Work Order. Failure to pay may result in immediate suspension of work until the account is settled. When the project is financed by an external entity, this agreement will be subject to the approval of the corresponding financing. The Company reserves the right to suspend work or withhold final delivery of the project until full payment owed is received.

  • Cancellation and Refund Policy

The Client may cancel this contract within three (3) business days following the date of signature, in accordance with the laws of the State of Florida. After this period, the Company shall have the right to recover costs related to materials purchased, permits requested, work performed and administrative expenses reasonably incurred for the execution of the project.

  • Responsibilities and Risk Limitations

The Client guarantees free and safe access to work areas for the entire duration of the project. The Company will not be responsible for damages resulting from pre-existing defective installations, hidden structural problems, defective wiring, defective plumbing, property settlement or any condition existing before the start of work, unless such damages are directly caused by the Company’s proven negligence. Exterior work may be temporarily suspended when weather conditions represent a safety risk or affect installation quality.

  • Photography and Confidentiality

The Client authorizes Future Home Restoration to take photographs and videos of the project before, during and after execution for promotional, advertising, educational and marketing purposes. The Company agrees not to disclose sensitive information or personal data of the Client without their prior authorization.

  • Construction Lien Disclosure

PURSUANT TO FLORIDA’S CONSTRUCTION LIEN LAW (SECTIONS 713.001-713.37, FLORIDA STATUTES), THOSE WHO WORK ON YOUR PROPERTY OR PROVIDE MATERIALS AND SERVICES AND ARE NOT PAID IN FULL HAVE THE RIGHT TO ENFORCE THEIR CLAIM FOR PAYMENT AGAINST YOUR PROPERTY. THIS CLAIM IS KNOWN AS A CONSTRUCTION LIEN. IF YOUR CONTRACTOR OR A SUBCONTRACTOR FAILS TO PAY SUBCONTRACTORS, SUB-SUBCONTRACTORS, OR MATERIAL SUPPLIERS, THOSE PERSONS WHO ARE OWED MONEY MAY LOOK TO YOUR PROPERTY FOR PAYMENT, EVEN IF YOU HAVE ALREADY PAID YOUR CONTRACTOR IN FULL. FLORIDA’S CONSTRUCTION LIEN LAW IS COMPLEX AND IT IS RECOMMENDED THAT YOU CONSULT AN ATTORNEY.

  • Dispute Resolution

Any dispute arising from this contract will be initially submitted to mediation before initiating any legal action. If no resolution is reached, the parties agree to submit to the jurisdiction of the competent courts of the State of Florida.
